Parents file lawsuit looking to block school tax cap question on the November ballot

MANCHESTER, N.H.- A lawsuit has been filed against a ballot question that will allow voters to decide if they want to put a tax cap on how much revenue goes to schools.

According to court documents the suit filed Monday in Merrimack Superior Court by David Bates of Warner, a former school budget committee member, and Kelly Wieser, a member of the Campton School Board alleges that the ballot questions are confusing for voters and are structured in a way that violates the state constitution.

The suit comes after lawmakers earlier this year passed passed legislation to put local property tax caps on ballots in every community in the state, both in the 2026 election and in 2028.

Meanwhile supports claims the questions will allow a larger number of voters to have a say in local spending.
