MANCHESTER, N.H.- Adam Montgomery will be brough back to New Hampshire to attend a scheduling conference next month in connection with his pending retrial on a second-degree murder charge for the death of his 5- year-old daughter, Harmony.

According to court documents, Montgomery is due back in the state on or around August 18th which will allow him to meet with his attorney ahead of his hearing which is scheduled for September 14th.

The news comes as the state plans to retire Montgomery for the death of his daughter, after the State Supreme Court overturned his second-degree murder conviction and agreed the state should have held different trials in relation to the various charges brought against him.

Montgomery had been sentenced to 45 years-to-life on the second-degree murder conviction and was also sentenced to an additional 11 years after admitting to charges of abuse of a corpse, falsifying physical evidence and witness tampering.

Montgomery is also serving at least 32 years on unrelated firearm charges in a Virgina prison.
