NH asks for dismissal of court petition by Pamela Smart

The state of New Hampshire on Monday asked a judge to dismiss the petition for a writ of habeas corpus made by Pamela Smart. Smart is serving a life sentence without parole for the 1990 murder of her husband, Gregg Smart, in Derry. Pamela Smart’s attorneys said a new scientific study demonstrates that a transcript accompanied by an audio recording steered jurors toward a predetermined and biased interpretation and conclusion. The state says the claims were either raised on appeal and resolved or the defense already had the opportunity to raise the claims but did not.
